How do you differ from a Debt Collector?
We conduct similar work to debt collectors but are specialist lawyers acting in the field of debt recovery/insolvency litigation.
We provide the functionality of debt collectors, i.e. issuing Letters of Demand and negotiating with debtors. The advantage of utilising debt recovery lawyers is that we have the in-house capacity to commence legal proceedings, rather than refer the matter to a third-party.

What is the collection process?

- Upon referral of a debt to us, a Letter of Demand is issued, requiring your debtor to pay the outstanding debt within a set time frame, i.e. 7 to 14 days. In about 50% of cases, debts are paid or settled at this point. Debtors often contact us to negotiate terms of payment or make payment directly to our clients before the expiry of the time frame on the Letter of Demand.
- Should payment not be received, legal action is generally commenced. We can provide you expert advice on what specific process within the litigation frame-work would deliver you the most efficient, cost-effective, favourable result.

Does debt recovery always result in litigation?
No. Although we are lawyers, debts are often resolved without involvement of the Courts. This is via either payments made by the debtor, a payment plan being entered, or a settlement being reached with the debtor.

How long does the average collection take?
Whilst debt recovery is not a ‘one-size fits all’ process, our clients can receive a favourable outcome within weeks of the debt referral. Matters without litigation can be resolved in a matter of days to weeks. If litigation is commenced, we can negotiate settlements with debtors to save clients time and money.
What is the minimum value of debt you can collect?
There is no ‘minimum value’ of debt that our firm can collect. Our clients instruct how they would like us to proceed, and Courts are structured to suit claims of varying amounts.
How do you charge for collection of debts?
Whilst debt collectors commonly charge on a commission basis (plus legal costs), any debt recovery matter referred to D. Riggio & Associates is only charged for legal work completed. This may include a flat fee for a Letter of Demand, or any costs for additional legal work completed. This saves our clients thousands of dollars in commission and provides great value for money. This means our client recover more of their debt.
